Larger Uttarakhand High Court bench stays assembly floor test

New Delhi:A larger bench of Uttarakhand High Court on Wednesday stayed the floor test in assembly which was scheduled for Thursday to test the majority of Harish Rawat government.

The larger bench accepted Centre’s plea that it was impermissible to revive assembly for a floor test when President’s Rule is in force.

The larger bench passed the order on a petition by the Centre challenging Tuesday’s single-judge order that had asked for floor test.

On Tuesday, the single judge bench of Justice U C Dhyani directed allowed floor test to be conducted in the assembly on March 31 and allowed even the nine disqualified rebel MLAs of the Congress to vote during the exercise.

A writ petition challenging the imposition of President’s rule in the state was filed by former chief minister Harish Rawat through his counsel and senior lawyer Abhishek Manu Singhvi.

The high court asked the Congress to file a reply by April 6 when it would commence the final hearing on the validity of Centre’s decision to impose President’s Rule.

For the Centre, attorney general Mukul Rohatgi and additional solicitors general Tushar Mehta and Maninder Singh argued that the single Judge bench had rightly inferred that the HC could not stay President’s Rule and yet incongruously ordered floor test.
