Jabalpur: The Madhya Pradesh High Court today rejected regular bail as well as extension of interim bail for sacked IAS officer Tinoo Joshi, facing graft charges, on medical grounds.
Justice S Kemkar dismissed her plea in a case of her assets allegedly being disproportionate to known sources of her income and directed her to surrender.
The prosecuting agency Lokayukta’s special public prosecutor Pankaj Dubey told PTI that the court said that if the applicant files medical documents on the basis of medical examinations by any government hospital or board, these could be considered in her fresh bail application.
Dubey contended that Tinoo had not submitted any document from government hospitals regarding her illness but provided documents of private hospitals which were either out of Madhya Pradesh or located in the USA, claiming she was unwell.
He drew the court’s attention to the Bhopal district court’s arrest warrant issued against her on May 11 for jumping the interim bail period.
He told the High Court said that Tinoo’s trial had not begun due to her absence, adding that the court had already given her three months’ time for treatment and surgery after she had pleaded the need to undergo treatment.
He also argued that she was not entitled to regular bail as per Section 439 of Criminal Procedure Code since she was not in custody.PTI
