Officers facing disciplinary proceedings not to get additional charge

New Delhi: The officers, who are facing disciplinary proceedings or having adverse annual confidential report, are not be given any additional charge in autonomous bodies or PSUs, the DoPT said in Office Memorandum F.No.4/212014-Estt.(Pay-II) dated April 16.

The Office Memorandum comes following a review of Fundamental Rules (FR) 49–regarding combination of appointments–done by Department of Personnel and Training (DoPT) with a view to ensure that the norms are applied in public interest.

“No person who is facing a disciplinary proceeding or is otherwise not suitable (for example who has an adverse entry in a recent Annual Performance Appraisal Report) should be given the additional charge,” the Office Memorandum said.

The provision of Fundamental Rules (FR) 49 apply only to government servants. “Appointments of an employee of an autonomous body or PSU etc to another such body would be governed by the rules of the individual’s employer,” the DoPT said.

It said the appointments made under the rules should follow the spirit of the FR to meet short term requirements only and it may be ensured that the provisions are not used to indirectly confer promotional benefits.
