Hyderabad: A Hyderabad High Court bench, headed by Chief Justice Kalyan Jyoti Sengupta, on Thursday directed Central Board of Direct Taxes (CBDT) to to take an independent action in a complaint against Income Tax Commissioner Uppuleti Devi Prasad for his alleged involvement in political activities and for canvassing for his wife Uppuleti Kalpana, a YSR Congress Party MLA, in the last general elections.While disposing of a public interest writ petition filed by Telugu Desam Party leader Varla Ramaiah, who lost the election to Uppuleti Kalpana, from Pamarru Assembly, alleging that the Commissioner had misused his official powers and participated in the electioneering to influence voters to ensure victory for his wife in the election.
Justice Sengupta told the CBDT to take an independent action in the case and pass appropriate order in accordance with law after examining the report.
Ramaiah said to the bench that despite several complaints no action was initiated by CBDT against Prasad.
However, Income tax Counsel submitted that the complaint was referred to the Central Board of Direct Taxes (CBDT) as the Income Tax Chief Commissioner of the Andhra Pradesh Zone has no power to take action against any Commissioner. The CBDT had sought an explanation and the Chief Commissioner submitted his report to CBDT on this issue.
